Rondeau and Treasury Board (Revenue Canada - Taxation)

  • Before: B. Turner
  • Appearances: B. Done, for the Grievor; G. Terkel, for the Employer
  • Decision Rendered: 1997-02-20

Subject terms:

Jurisdiction - Job description - Estoppel - grievor claimed that employer had failed to provide her with a complete and current statement of the duties and responsibilities of her position - employer alleged that this grievance was outside the jurisdiction of an adjudicator in light of section 7 of the Public Service Staff Relations Act as in reality it related to the assignment of duties to and classification of positions - adjudicator concluded that he had the requisite jurisdiction as collective agreement granted grievor the right to receive from employer a complete and accurate job description - adjudicator was not satisfied on the evidence that employer required grievor to perform any duties which were not reflected in her job description - grievor failed to establish that estoppel applied.

Grievance denied.
